DISTANCE SALES AGREEMENT
Last Updated: October 27, 2026
This Distance Sales Agreement governs online purchases made through the House of Shiver website, subject to the mandatory consumer protection laws applicable to the transaction.
Where Turkish law applies, this Agreement is intended to support compliance with Turkish consumer protection legislation, including Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.
The order-specific details displayed during checkout and in the order confirmation form part of the transaction records.

The seller's legal identity and contact information must be completed before this Agreement is used for actual sales.
1.2. Buyer
The Buyer is the individual or legal entity whose name and contact details are entered during checkout and whose order is accepted by the Seller.
The Buyer's order-specific details, including billing address, delivery address, and contact information, are recorded in the checkout and order confirmation.
For consumer protection purposes, the term “Consumer” refers to a buyer acting for purposes outside their commercial or professional activity, where that definition applies under the relevant law.
ARTICLE 2 – SUBJECT OF THE AGREEMENT
The subject of this Agreement is the sale and delivery of the product or products ordered by the Buyer through the House of Shiver online store, together with the rights and obligations of the parties under applicable law.
The Agreement covers:
-
Product information and characteristics.
-
Order placement and acceptance.
-
Purchase price and payment.
-
Delivery and shipping.
-
The statutory right of withdrawal.
-
Returns, refunds, and applicable remedies.
-
Other mandatory consumer rights and obligations.
ARTICLE 3 – PRODUCT INFORMATION
The product or products covered by this Agreement are identified in the Buyer's order confirmation.
The order details should include, as applicable:
-
Product name and description.
-
Size, colour, quantity, and selected variations.
-
Unit price, including applicable taxes.
-
Discounts applied to the order.
-
Shipping and delivery charges.
-
Total amount payable.
-
Payment method.
-
Delivery address and estimated delivery information.
Product photographs and descriptions are intended to represent the products accurately. Minor variations in presentation caused by screen settings do not necessarily constitute a product defect, but statutory rights concerning misleading descriptions, defects, or non-conforming goods remain unaffected.
ARTICLE 4 – ORDER AND CONTRACT FORMATION
The Buyer places an order by selecting the relevant products, providing the required information, choosing an available payment method, and completing checkout.
Before the order is submitted, the Buyer should have the opportunity to review the essential order details and total amount payable.
The contract is formed in accordance with the applicable law and the order acceptance process used by the Seller.
The Seller will provide an order confirmation electronically. The Buyer should retain the confirmation for future reference.
If an order cannot be fulfilled, the Seller will inform the Buyer and arrange any refund or other remedy required by applicable law.
ARTICLE 5 – PRICE AND PAYMENT
The price payable for the order is the total shown at checkout before the Buyer completes the purchase.
The total may include:
-
Product prices.
-
Applicable taxes.
-
Shipping charges.
-
Any other charge lawfully disclosed and accepted before the order is placed.
No additional charge will be imposed without an appropriate legal basis and the Buyer's required consent.
Payments are processed through the payment methods made available at checkout. Payment processing may be carried out by third-party payment service providers under their applicable terms and security procedures.
If payment is unsuccessful, the order may not be processed until the payment issue is resolved.
ARTICLE 6 – DELIVERY
The Seller will arrange delivery to the address provided by the Buyer.
-
The standard estimated delivery time is 5–7 business days, unless a different delivery estimate is displayed or agreed at checkout.
-
Business days exclude weekends and public holidays.
-
Delivery estimates may vary according to destination, product availability, courier operations, and exceptional circumstances.
-
Shipping fees and available delivery methods will be displayed before checkout is completed.
-
The Buyer is responsible for providing accurate delivery information.
-
The Seller will comply with the applicable statutory delivery deadline and any specific delivery commitment made for the order.
Where Turkish distance-selling law applies, the Seller must comply with the legally applicable delivery deadline, which generally may not exceed 30 days unless a statutory exception applies.
If delivery becomes impossible, the Seller will notify the Buyer and refund the amounts required by applicable law.
ARTICLE 7 – TRANSFER OF RISK
The allocation of risk for loss of or damage to the goods during delivery will be determined in accordance with the mandatory law applicable to the transaction.
Where the relevant consumer protection rules provide that risk remains with the Seller until the Consumer or a designated third party takes physical possession of the goods, this rule will apply.
Nothing in this Agreement transfers risk to the Buyer earlier than permitted by mandatory law.
ARTICLE 8 – RIGHT OF WITHDRAWAL
Where the Turkish Regulation on Distance Contracts applies, the Consumer generally has the right to withdraw from the contract within 14 days, without giving a reason and without paying a contractual penalty.
For goods, the withdrawal period generally starts when the Consumer or a third party designated by the Consumer, other than the carrier, receives the goods.
Where permitted by law, withdrawal may also be exercised before the goods are delivered.
To exercise the right of withdrawal, the Consumer must communicate a clear withdrawal statement to the Seller within the applicable period.
Withdrawal requests may be submitted to:
Email: info@houseofshiver.com
The request should include the order number and sufficient information to identify the purchase.
The Consumer is not required to use a particular form if applicable law permits another clear written statement.
ARTICLE 9 – RETURN OF GOODS
After notifying the Seller of withdrawal, the Consumer must return the goods within the period required by applicable law, generally 14 days from the withdrawal notification under Turkish distance-selling rules.
The Consumer should:
-
Package the goods securely.
-
Include the order number or other order identification.
-
Use the return instructions and designated carrier provided where applicable.
-
Retain proof of shipment until the return is resolved.
The Seller may request that goods be returned with their original tags, labels, packaging, and accessories where applicable.
However, the removal of a tag or packaging does not automatically eliminate a statutory right of withdrawal. Any liability for a reduction in the value of goods will be assessed under the applicable law, including whether the goods were handled beyond what was reasonably necessary to establish their nature, characteristics, and functioning.
ARTICLE 10 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The statutory right of withdrawal may not apply to certain categories of goods or contracts expressly excluded under applicable law.
Depending on the circumstances, exclusions may include:
-
Goods made to the Consumer's specifications or clearly personalised.
-
Sealed goods unsuitable for return for health protection or hygiene reasons, where the seal has been broken after delivery.
-
Other goods or contracts specifically excluded by the applicable legislation.
An exclusion will apply only where its legal requirements are satisfied. Clothing products are not automatically excluded from withdrawal solely because they are clothing.
ARTICLE 11 – RETURN SHIPPING COSTS
Return shipping costs will be allocated in accordance with the applicable consumer protection legislation and the information provided to the Consumer before the contract was concluded.
Where the Seller is legally required to bear the return shipping costs, those costs will not be charged to the Consumer.
The Seller will communicate any legally permitted return shipping arrangements in the applicable pre-contractual information and return instructions.
If the goods are defective, damaged, incorrect, or otherwise non-conforming, the Consumer retains the remedies available under applicable law.
ARTICLE 12 – REFUNDS
Following a valid withdrawal, the Seller will refund the amounts required by law within the applicable statutory deadline.
Where Turkish distance-selling rules apply:
-
Refunds must generally be made within 14 days, subject to the statutory rules governing when the period begins.
-
The refund will include the required standard delivery charges.
-
Additional charges arising from the Consumer's choice of a more expensive delivery method may be treated in accordance with applicable law.
-
Refunds will generally be made through the original payment method unless another lawful arrangement is agreed.
-
The Consumer will not be charged a penalty merely for exercising a statutory right of withdrawal.
Where the law permits the Seller to withhold a refund until goods are returned or evidence of dispatch is provided, the Seller may exercise that right in accordance with the applicable statutory conditions.
The time required for the bank or payment provider to credit the funds may vary.
ARTICLE 13 – DEFECTIVE OR NON-CONFORMING GOODS
If a product is defective, damaged, incorrect, or does not conform to the contract, the Consumer may exercise the remedies available under applicable law.
Depending on the circumstances and statutory requirements, these remedies may include:
-
Withdrawal or termination of the contract where legally available.
-
A refund.
-
Replacement.
-
Repair.
-
A price reduction.
-
Other applicable legal remedies.
The Consumer should contact info@houseofshiver.com with the order number and a description of the issue. Photographs may be requested to assist with the assessment.
Any inspection or evidence request will be handled without unlawfully restricting the Consumer's statutory rights.
ARTICLE 14 – OBLIGATIONS OF THE BUYER
The Buyer agrees to:
-
Provide accurate order, billing, and delivery information.
-
Review the order details before completing checkout.
-
Make payment using a valid available payment method.
-
Provide reasonable cooperation necessary for delivery and return arrangements.
-
Follow applicable return instructions while retaining all mandatory statutory rights.
Nothing in this Article requires the Buyer to waive rights granted by applicable consumer protection legislation.

The Seller agrees to:
-
Provide accurate pre-contractual information as required by law.

Display the relevant product information and total payable amount before the order is completed.

Provide order confirmation and relevant transaction information.
-
Respect statutory withdrawal, refund, and product conformity rights.
-
Handle personal information in accordance with applicable data protection legislation.
-
Address customer enquiries and complaints through the contact channel provided.
ARTICLE 16 – FORCE MAJEURE AND EXCEPTIONAL EVENTS
Events beyond the reasonable control of a party may affect delivery or other contractual obligations.
Examples may include natural disasters, major disruptions to transport networks, public emergencies, or government restrictions.
The affected party will take reasonable steps to mitigate the impact and communicate material delays where appropriate.
This Article does not remove any mandatory refund, cancellation, or consumer remedy required by applicable law.
ARTICLE 17 – PERSONAL DATA
Personal information collected in connection with the order will be processed for purposes such as order fulfilment, payment administration, delivery, customer support, accounting, fraud prevention, and compliance with legal obligations.
Further details are provided in the House of Shiver Privacy Policy.
Where applicable, processing will comply with the Turkish Personal Data Protection Law No. 6698 (KVKK) and other relevant data protection legislation.
Privacy-related enquiries may be sent to info@houseofshiver.com.
ARTICLE 18 – COMPLAINTS AND DISPUTE RESOLUTION
For questions, complaints, or concerns relating to an order, the Buyer may contact:
House of Shiver
Email: info@houseofshiver.com
Where Turkish consumer law applies, Consumers may also apply to the competent Consumer Arbitration Committee or Consumer Court, depending on the nature and value of the dispute and the applicable procedural rules.
Consumers in other countries may have additional rights or access to dispute resolution mechanisms under the mandatory laws applicable in their jurisdiction.
ARTICLE 19 – APPLICABLE LAW AND MANDATORY RIGHTS
This Agreement will be interpreted in accordance with the law applicable to the transaction.
Where Turkish law applies, the relevant provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts will apply.
For international transactions, mandatory consumer protection provisions of the Consumer's country may also apply.
Nothing in this Agreement excludes, limits, or waives a statutory right that cannot legally be excluded or limited.
ARTICLE 20 – EFFECTIVE DATE AND ORDER RECORDS
This Agreement applies to the relevant order from the time the contract is formed in accordance with the applicable order acceptance process.
The order confirmation, checkout details, and any applicable pre-contractual information should be retained as part of the transaction records.
